1 Acceptance of Terms

1.1 Please read these Terms and Conditions of Purchase (“Terms”) carefully as use of this service on the worldwide web directed by the URL www.misshu.com (“the Website”) constitutes your acceptance of these Terms. Misshu Limited (from here referred to as “Misshu”) reserves the right to update the Terms at any time by displaying amended Terms on the Website. You will be deemed to have agreed to the amended Terms when you next use this Website following any amendment.

2 Your use of this Website

2.1 Misshu admits you to this Website in order to provide you the opportunity to buy shoes and accessories offered on the Website (“the Goods”). The Terms and Conditions of Use of the Website and Privacy Policy are part of these Terms. Misshu in its sole discretion shall determine your compliance with these Terms and shall have the right to prevent you from using the Website.

3 Shopping Online

3.1 Misshu offers secure on-line transactions. You can select Goods from the Website by choosing the style and colour and add them to your shopping basket. You can monitor the total number of Goods in your shopping basket and your spending by checking the details displayed on your screen at any time.

3.2 When you have finished putting items in your basket you should proceed to the order page where you are able to review your selection and delete items if desired.

3.3 You should then proceed to the checkout area where you will be asked for details such as your billing address and delivery address.

4 Price and Payment Methods

4.1 The prices payable for Goods that you order are as set out in our website.

4.2 All prices displayed are inclusive of VAT.

4.3 You will be requested to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in section 9.

4.4 You can pay by credit or debit card (Visa, Visa Delta/Debit, Visa Electron, Mastercard, UK Switch/Maestro, Solo).

5 Availability

5.1 All items are subject to availability. We will inform you as soon as possible if the Goods you have ordered are not available.

6 Description of Goods

6.1 All descriptions of Goods are displayed and given in good faith by Misshu, however, the colours, height of heel and description of fabric and decorations given are a guide only and may vary slightly. We make every effort to display as accurately as possible the colours and description of the Goods that appear on the Website, however, as the actual colours you see will depend on your computer monitor, we cannot guarantee that your computer monitor's colour display will accurately reflect the colour of the Goods on delivery. Misshu does not in any circumstances accept responsibility for the accuracy or otherwise of the advertisement nor is any kind of warranty expressed or implied by such publication.

7 Fashion and Occasional Footwear

7.1 Please note that some of the Goods sold on this Website are intended for occasional wear only; this includes, without limitation shoes and sandals covered in delicate fabric, non-water proof fabric or decorations of any sort.

7.2 The delicate nature of the fabric is not intended, and is unlikely to withstand, the rigours of every day wear or wet weather conditions and extra care should be taken when wearing such shoes.

7.3 Decorations such as sequins, beads, diamantes, stones and embroidery are delicate and will not withstand abrasive treatment.

7.4 MISSHU DOES NOT GUARANTEE GOODS MADE FROM DELICATE FABRIC AND DECORATIONS AS DESCRIBED ABOVE AND ACCEPTS NO RESPONSIBILITY FOR DAMAGE CAUSED. NO LIABILITY FOR DAMAGED GOODS WILL BE ACCEPTED.

8 Buying Goods

8.1 By proceeding through the payment stages of the Website you are offering to purchase the Goods. The contract is not concluded between you and Misshu until Misshu confirms to you that the Goods are available for sale.

9 Delivery and Postage

9.1 You will receive an electronic receipt of your purchase (in the form of an email), with your reference number against each purchase. You should quote that reference number in case of queries. You will also receive a hard copy receipt of your purchase with your Goods.

9.2 Misshu uses a registered courier service provided by UPS for all UK addresses and products will normally be delivered within 3-4 working days (this is approximate), however, this may take longer so please bear with us. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. You should anticipate a longer delivery period where delivery periods incorporate public holidays.

9.3 Misshu will incorporate a standard delivery charge of £4.99 per item for orders within the UK.

9.4 Misshu also offers a next day delivery service to UK addresses for £9.99 per item. Misshu uses a registered courier service provided by UPS for all UK addresses. Please Misshu’s order processing (described in points 9.7 & 9.8) for orders placed after 2pm and on weekends and public holidays.

9.5 For delivery to the following European countries Misshu will incorporate a standard delivery charge of £7.99 per item: Austria, Belgium, Denmark, Finland, France, Germany, Greenland, Iceland, Ireland, Italy, Liechtenstein, Netherlands, Norway, Portugal, San Marino, Spain, Sweden, Switzerland, and Vatican.

9.6 For delivery to all other overseas countries (excluding the UK and countries in point 9.5) Misshu will incorporate a standard delivery charge of £9.99 per item.

9.7 Orders placed between 2pm on a working day will be processed and shipped the same day providing your payment has been accepted and your items are in stock. Orders placed after this 2pm deadline will be dispatched on the next working day.

9.8 Orders placed on weekends and public holidays will be dispatched on the next working day.

10 Account Security

10.1 You are responsible for maintaining the confidentiality of your password and account and any activities that occur within your account. Misshu shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

11 Cancellation by us

11.1 Misshu reserve the right to cancel the contract if:

  1. there is insufficient stock to deliver the Goods you have ordered;
  2. delivery is not made to your area; or
  3. one or more of the Goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by Misshu’s suppliers.

11.2 If Misshu do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

12 Cancellation of your Order by you

12.1 Prior to receiving your Goods you may cancel your order at any time. Once you are in receipt of your order the Returns Policy will apply (please see below).

14 Returning faulty goods

14.1 If your Goods are faulty please contact Misshu within 5 days of receipt of the Goods (please see term 8.1) and we will issue you with a return label (which in the case of UK customers shall be freepost). We will supply you with replacement Goods or a full refund of the purchase price and delivery costs where the Goods are faulty. ‘Faulty’ means that the shoe has a manufacturing fault or hidden defect, which was present at the time of delivery. A shoe is not faulty if it has become damaged or faulty because of wear and tear, misuse, or accidental damage. Please note that Misshu checks the quality and workmanship of all Goods very carefully prior to despatch.

14.2 Please note that you are responsible for the Goods until they are returned safely to Misshu, therefore, Misshu recommends that you send the Goods by Special Delivery or some other form of insured postage.

15 UK Customers

15.1 For UK customers, we are happy to pay for return postage of faulty Goods, and we shall provide a freepost label on request. Send your return via the Royal Mail. Please obtain a Certificate of Posting (available free from the Post Office) for all returns, so that we can complete your request in the event of items being lost in transit. The Post Office will stamp this and supply a tracking reference number to prove the item(s) have been returned. You should keep this Certificate until you have received your refund or replacement.

16 International Customers

16.1 Send your faulty Goods via a prepaid, insured, traceable method, marking your package clearly as Returned Goods to avoid delays at Customs. Please retain your shipping documentation, so that we can complete your request in the event of items being lost in transit.

16.2 We will let you know as soon as we receive the Goods, and will then endeavour to process your request for either a refund or replacement as quickly as possible. In some cases this may take several days, so we would be grateful if you could bear with us.

16.3 If you have requested a refund, or replacement of a lower value than the returned goods, a refund will be credited back to the payment card used to pay for the original order. We will let you know as soon as the refund has been processed.

16.4 If you have requested replacements of a higher value, any difference due to Misshu will be charged to the card used to pay for the original order.

17 Liability

17.1 If the Goods we deliver are not what you ordered or are damaged or faulty or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within [5] working days of the delivery of the Goods in question.

17.2 If you do not receive Goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the Goods.

17.3 If you notify a problem to us under this condition, our only obligation will be, at your option

  1. to make good any shortage or non-delivery;
  2. to replace or repair any goods that are damaged or faulty; or
  3. to refund to you the amount paid by you for the Goods in question in whatever way we choose.

17.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Goods in question under clause 18.3(c) above.

17.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from our site. The importation or exportation of certain of our Goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.

17.6 Notwithstanding the foregoing, nothing in these Terms

17.7 is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

18 Statutory Rights

89.1 Your statutory rights are not affected by our returns policy.

19 Title

19.1 Misshu shall retain title to and ownership of the Goods until Misshu has received payment in full of all sums due for the Goods.

20 Risk

20.1 The risk of loss or damage to the Goods shall pass to you upon delivery of the Goods.
